Terms of Use

You must have the legal capacity to enter a binding agreement in your jurisdiction. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization. You are responsible for maintaining the confidentiality of your credentials and for activity under your account. Notify us promptly of unauthorized use.

Voiceback.AI provides software and related services that may include AI-assisted messaging, customer engagement tools, analytics, integrations, and configuration features. Features may change over time. We may suspend or modify the Services for maintenance, security, legal, or operational reasons.

You agree not to:

• Violate applicable laws or third-party rights;
• Send unlawful, harmful, harassing, fraudulent, or deceptive content;
• Attempt to gain unauthorized access to systems, data, or accounts;
• Interfere with or disrupt the Services or other users’ use;
• Reverse engineer, scrape, or probe the Services except as permitted by law;
• Use the Services to build a competing product without our consent; or
• Circumvent usage limits, billing, or security controls.

You are responsible for content you submit and for compliance with messaging, telemarketing, data protection, and industry-specific rules that apply to your use cases (including opt-in and opt-out requirements where applicable).

Our collection and use of personal information is described in our Privacy Policy. You are responsible for obtaining any necessary consents and providing required notices to your end users when you use the Services to process their data.

Outputs from AI or automated features may be inaccurate or incomplete. You should verify important information before relying on it. You remain responsible for your use of AI outputs and for compliance with laws applicable to automated communications in your region and industry.

The Services may integrate with third-party platforms (for example, messaging providers or CRMs). Those services are governed by separate terms and policies. We are not responsible for third-party services or their availability.

We and our licensors own the Services, including software, branding, documentation, and related materials, subject to any open-source licenses that apply to components we use. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to use the Services during your subscription or trial. You retain rights in content you submit; you grant us a license to host, process, and display that content as needed to provide and improve the Services.

Paid plans, fees, taxes, and billing cycles are as stated at purchase or in your order form. Unless otherwise agreed, fees are non-refundable. We may change pricing with reasonable notice where permitted. Trials may convert to paid plans according to the terms presented at signup.

Each party may receive non-public information from the other. The receiving party will use reasonable care to protect confidential information and will use it only for the purpose of the Services, except as required by law.

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER Voiceback.AI NOR ITS SUPPLIERS WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICES OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY. OUR AGGREGATE LIABILITY FOR CLAIMS ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF THE AMOUNTS YOU PAID US FOR THE SERVICES IN THE TWELVE MONTHS BEFORE THE CLAIM OR ONE HUNDRED US DOLLARS (USD $100), EXCEPT WHERE LIABILITY CANNOT BE LIMITED BY LAW.

You will defend and indemnify Voiceback.AI and its affiliates, officers, and employees against third-party claims, damages, and costs (including reasonable attorneys’ fees) arising from your content, your use of the Services in violation of these Terms, or your violation of law or third-party rights.

You may stop using the Services at any time. We may suspend or terminate access for breach of these Terms, risk to security or others, non-payment where applicable, or as required by law. Provisions that by their nature should survive (including intellectual property, disclaimers, limitation of liability, indemnity, and governing law) will survive termination.

These Terms are governed by the laws applicable to the primary place of business of Voiceback.AI, without regard to conflict-of-law principles, except where mandatory consumer protections in your country require otherwise. Courts in that jurisdiction will have exclusive venue, unless applicable law requires otherwise. Nothing limits either party’s right to seek injunctive relief for misuse of intellectual property or confidential information.

We may update these Terms from time to time. We will post the updated Terms and revise the “Last updated” date. Continued use after changes become effective constitutes acceptance, except where additional consent is required by law.
